深圳勞務派遣工與正式工享有同工同酬的權利
王某(mou)(mou)是一(yi)家勞務派遣公(gong)司的(de)(de)(de)員(yuan)工(gong)(gong)(gong)。2014年6月10日,王某(mou)(mou)被(bei)派遣到(dao)某(mou)(mou)煤炭企(qi)(qi)(qi)業(ye)(ye)工(gong)(gong)(gong)作。工(gong)(gong)(gong)作一(yi)月后,王某(mou)(mou)領(ling)(ling)到(dao)工(gong)(gong)(gong)資2000元。但同(tong)時(shi)王某(mou)(mou)得知,企(qi)(qi)(qi)業(ye)(ye)里與(yu)自己崗位相同(tong)的(de)(de)(de)員(yuan)工(gong)(gong)(gong)的(de)(de)(de)工(gong)(gong)(gong)資為每月3000元。王某(mou)(mou)感(gan)覺企(qi)(qi)(qi)業(ye)(ye)對自己不公(gong)平,于是與(yu)派遣公(gong)司煤炭企(qi)(qi)(qi)業(ye)(ye)的(de)(de)(de)領(ling)(ling)導(dao)溝通(tong),希望(wang)能與(yu)同(tong)崗位其(qi)他(ta)員(yuan)工(gong)(gong)(gong)的(de)(de)(de)工(gong)(gong)(gong)資一(yi)樣。但煤炭企(qi)(qi)(qi)業(ye)(ye)的(de)(de)(de)領(ling)(ling)導(dao)表(biao)示,王某(mou)(mou)不是煤炭企(qi)(qi)(qi)業(ye)(ye)的(de)(de)(de)員(yuan)工(gong)(gong)(gong),不能與(yu)其(qi)他(ta)同(tong)崗位的(de)(de)(de)員(yuan)工(gong)(gong)(gong)享(xiang)受(shou)(shou)同(tong)樣的(de)(de)(de)工(gong)(gong)(gong)資待遇。無(wu)奈,王某(mou)(mou)提起(qi)勞動仲(zhong)裁(cai),要求享(xiang)受(shou)(shou)每月3000元的(de)(de)(de)工(gong)(gong)(gong)資待遇。王某(mou)(mou)的(de)(de)(de)主(zhu)張能得到(dao)支持嗎?

我國《勞(lao)動(dong)合同(tong)法》第六十(shi)三(san)條明(ming)確規定(ding):“被派遣(qian)(qian)勞(lao)動(dong)者(zhe)(zhe)(zhe)享有(you)與(yu)(yu)用工(gong)(gong)(gong)(gong)單位(wei)(wei)(wei)(wei)(wei)的(de)(de)(de)勞(lao)動(dong)者(zhe)(zhe)(zhe)同(tong)工(gong)(gong)(gong)(gong)同(tong)酬(chou)的(de)(de)(de)權利。用工(gong)(gong)(gong)(gong)單位(wei)(wei)(wei)(wei)(wei)應當(dang)按照同(tong)工(gong)(gong)(gong)(gong)同(tong)酬(chou)原(yuan)則,對被派遣(qian)(qian)勞(lao)動(dong)者(zhe)(zhe)(zhe)與(yu)(yu)本單位(wei)(wei)(wei)(wei)(wei)同(tong)類崗位(wei)(wei)(wei)(wei)(wei)的(de)(de)(de)勞(lao)動(dong)者(zhe)(zhe)(zhe)實行相同(tong)的(de)(de)(de)勞(lao)動(dong)報酬(chou)分配辦(ban)法。用工(gong)(gong)(gong)(gong)單位(wei)(wei)(wei)(wei)(wei)無同(tong)類崗位(wei)(wei)(wei)(wei)(wei)勞(lao)動(dong)者(zhe)(zhe)(zhe)的(de)(de)(de),參照用工(gong)(gong)(gong)(gong)單位(wei)(wei)(wei)(wei)(wei)所在地(di)相同(tong)或(huo)者(zhe)(zhe)(zhe)相近崗位(wei)(wei)(wei)(wei)(wei)勞(lao)動(dong)者(zhe)(zhe)(zhe)的(de)(de)(de)勞(lao)動(dong)報酬(chou)確定(ding)。勞(lao)務派遣(qian)(qian)單位(wei)(wei)(wei)(wei)(wei)與(yu)(yu)被派遣(qian)(qian)勞(lao)動(dong)者(zhe)(zhe)(zhe)訂立(li)的(de)(de)(de)勞(lao)動(dong)合同(tong)和與(yu)(yu)用工(gong)(gong)(gong)(gong)單位(wei)(wei)(wei)(wei)(wei)訂立(li)的(de)(de)(de)勞(lao)務派遣(qian)(qian)協(xie)議,載明(ming)或(huo)者(zhe)(zhe)(zhe)約定(ding)的(de)(de)(de)向被派遣(qian)(qian)勞(lao)動(dong)者(zhe)(zhe)(zhe)支付的(de)(de)(de)勞(lao)動(dong)報酬(chou)應當(dang)符(fu)合前(qian)款規定(ding)。”實踐中(zhong),對于(yu)同(tong)工(gong)(gong)(gong)(gong)同(tong)酬(chou)往(wang)往(wang)需要具備以下三(san)個條件(jian),即崗位(wei)(wei)(wei)(wei)(wei)相同(tong)、工(gong)(gong)(gong)(gong)作量相同(tong)、業績(ji)相同(tong)。具備這三(san)個條件(jian),勞(lao)動(dong)者(zhe)(zhe)(zhe)就(jiu)有(you)權享有(you)同(tong)工(gong)(gong)(gong)(gong)同(tong)酬(chou)的(de)(de)(de)權利。
針對(dui)本(ben)案,王某被派遣到煤炭企(qi)業(ye)后,在工(gong)作崗位工(gong)作量工(gong)作業(ye)績大體(ti)相同的(de)情況下,就(jiu)享有與用工(gong)單位的(de)員(yuan)工(gong)同工(gong)同酬的(de)權利,用工(gong)單位不得以王某非本(ben)單位的(de)員(yuan)工(gong)為借口(kou)推諉。因此,王某的(de)主張(zhang)能(neng)夠(gou)得到支持。
另外,在實際操(cao)作(zuo)中,部分用工(gong)(gong)單位自己面試招聘員(yuan)工(gong)(gong),卻與員(yuan)工(gong)(gong)簽訂勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)合(he)(he)同,勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)工(gong)(gong)的(de)(de)(de)工(gong)(gong)資(zi)由勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)公(gong)(gong)司發(fa),“假派(pai)(pai)(pai)(pai)遣(qian)(qian)、真用工(gong)(gong)”現(xian)象(xiang)突出。在2013年7月1日新修訂的(de)(de)(de)《勞(lao)(lao)(lao)(lao)動合(he)(he)同法》施(shi)(shi)行(xing)(xing)前,成立一家勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)公(gong)(gong)司只需(xu)(xu)要50萬(wan)元(yuan)的(de)(de)(de)注冊資(zi)本,而且不(bu)需(xu)(xu)要任何行(xing)(xing)政許可(ke)。導致了(le)(le)很多勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)公(gong)(gong)司借資(zi)注冊,拿到營業(ye)執(zhi)照后就將資(zi)本抽回,而工(gong)(gong)商部門(men)又(you)往往對(dui)這(zhe)(zhe)類(lei)企(qi)業(ye)疏(shu)于管(guan)理,一旦發(fa)生勞(lao)(lao)(lao)(lao)動糾紛,這(zhe)(zhe)些(xie)空殼公(gong)(gong)司經(jing)(jing)(jing)常 “攜款潛逃”,很難(nan)被追究,勞(lao)(lao)(lao)(lao)動者(zhe)的(de)(de)(de)合(he)(he)法權益(yi)難(nan)以(yi)(yi)得(de)到保障(zhang)。為遏(e)制這(zhe)(zhe)種不(bu)良現(xian)象(xiang),2013年7月1日新修訂的(de)(de)(de)《勞(lao)(lao)(lao)(lao)動合(he)(he)同法》大大提(ti)高(gao)了(le)(le)經(jing)(jing)(jing)營勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)業(ye)務(wu)(wu)(wu)的(de)(de)(de)門(men)檻,注冊資(zi)本從以(yi)(yi)前的(de)(de)(de)50萬(wan)元(yuan)提(ti)高(gao)到了(le)(le)200萬(wan)元(yuan),并且賦予勞(lao)(lao)(lao)(lao)動行(xing)(xing)政部門(men)對(dui)經(jing)(jing)(jing)營勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)業(ye)務(wu)(wu)(wu)的(de)(de)(de)行(xing)(xing)政許可(ke)權利。此外,新法還界定(ding)(ding)了(le)(le)勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)用工(gong)(gong)只能在“三性”—臨時性、輔助性或(huo)替代性崗位實施(shi)(shi)。明確(que)規(gui)(gui)定(ding)(ding)用工(gong)(gong)單位應嚴格控制勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)用工(gong)(gong)數量,不(bu)得(de)超過用工(gong)(gong)總量的(de)(de)(de)一定(ding)(ding)比例。新法還規(gui)(gui)定(ding)(ding)未(wei)經(jing)(jing)(jing)許可(ke),擅自經(jing)(jing)(jing)營勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)業(ye)務(wu)(wu)(wu)的(de)(de)(de),沒收(shou)違(wei)法所(suo)得(de),并處違(wei)法所(suo)得(de)一倍(bei)以(yi)(yi)上五倍(bei)以(yi)(yi)下(xia)的(de)(de)(de)罰款。這(zhe)(zhe)一系列規(gui)(gui)定(ding)(ding)的(de)(de)(de)實施(shi)(shi),對(dui)規(gui)(gui)范勞(lao)(lao)(lao)(lao)務(wu)(wu)(wu)派(pai)(pai)(pai)(pai)遣(qian)(qian)的(de)(de)(de)亂象(xiang)、保護(hu)勞(lao)(lao)(lao)(lao)動者(zhe)的(de)(de)(de)合(he)(he)法權益(yi)起到了(le)(le)巨大的(de)(de)(de)作(zuo)用。
